Terms of Service

Effective date: May 12, 2026

1. Who can use it

You must be at least 18 years old and authorized to bind any organization you represent. You're responsible for everything that happens under your account, including content posted to third-party platforms via connected social accounts.

2. What you can do with the platform

You can use C(AI)DENCE to:

• Plan, generate, schedule, and publish marketing content to platforms you've explicitly connected
• Manage your brand assets, campaigns, and creator relationships within your organization
• Invite team members and assign them roles within your workspace

3. What you can't do

• Use the platform to publish content that violates the terms of any connected third-party platform (LinkedIn, X, Meta, YouTube, etc.)
• Reverse-engineer, scrape, or otherwise extract structured data from the platform's UI or APIs without written permission
• Share account credentials with users outside your organization
• Use the platform to generate content that is illegal, defamatory, harassing, or that infringes third-party rights (including copyright, trademark, and right of publicity)
• Resell or sublicense access to the platform without a written reseller agreement

4. Content ownership

You retain ownership of all content you upload to the platform or generate using it. You grant C(AI)DENCE a limited license to store, process, and transmit that content as required to operate the platform on your behalf — including forwarding it to the third-party platforms you connect.

AI-generated content carries the same legal status as any other output: you are responsible for what you publish, regardless of whether the model produced the draft.

5. Third-party platforms

When you connect a third-party platform (LinkedIn, X, Meta, YouTube, etc.) you authorize C(AI)DENCE to act on your behalf using the OAuth scopes you approve. Those platforms have their own terms; we don't override them. If a platform suspends or rate-limits your connected account, that's between you and them — we'll surface the error but can't arbitrate.

6. Billing

Paid plans are billed monthly or annually in advance via Stripe. Refunds are issued at our discretion. Cancellations take effect at the end of the current billing period; you retain access until then.

7. Termination

We can suspend or terminate your account for material breach of these terms, abuse of the platform, or non-payment. You can cancel your account at any time from Settings → Account & Security; data is anonymized and OAuth tokens revoked per the privacy policy.

8. Disclaimers

The platform is provided “as is.” AI-generated output may contain errors; review before publishing. We make no warranty that the platform will be uninterrupted, that every feature will work in every environment, or that the third-party platforms we integrate with will behave consistently. Marketing outcomes (reach, engagement, conversions) depend on factors outside our control.

9. Limitation of liability

To the maximum extent allowed by law, our total liability for any claim arising from your use of the platform is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, or consequential damages.

10. Changes to these terms

We may update these terms as the platform evolves. Material changes are announced on the dashboard and reflected in the “last updated” date above. Continued use after a change constitutes acceptance.

11. Governing law, venue & dispute resolution

These terms are governed by the laws of India, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these terms or the platform will be resolved in the courts of Mumbai, India, unless the parties agree in writing to binding arbitration under the Arbitration and Conciliation Act, 1996. Each party waives the right to a class action. If any provision of these terms is held unenforceable, the remainder remains in effect. These terms are the entire agreement between you and C(AI)DENCE regarding the platform and supersede any prior agreements on the same subject. Nothing in this section limits any non-waivable right you may have under the laws of your residence.
